1. Introduction & Acceptance of Terms

These Terms & Conditions govern the use of services provided by Devifusion, including dine-in, takeaway, online delivery, catering, and subscription-based offerings. By accessing our premises, placing an order, or engaging with our services in any form, you acknowledge that you have read, understood, and agreed to be legally bound by these Terms.

These Terms are intended to ensure transparency, protect both parties, and define the scope of responsibilities and limitations associated with our services.

2. Scope of Services

Devifusion operates as a multi-cuisine food service provider offering a wide range of services including restaurant dining, takeaway, online food delivery through third-party platforms, catering for events, and customized meal plans.

While we strive to maintain consistency across all service channels through our central kitchen operations and standardized processes, service availability may vary depending on operational capacity, location, and external conditions.

3. Food Safety, Hygiene & Regulatory Compliance

We adhere strictly to the guidelines laid down by the Food Safety and Standards Authority of India (FSSAI) and maintain high standards of hygiene, food preparation, and storage.

However, customers must understand that food preparation in a multi-cuisine kitchen involves handling various ingredients, and despite all precautions, the possibility of cross-contamination cannot be entirely eliminated. Consumption of food is at the customer’s own discretion and risk.

4. Allergy & Dietary Responsibility

Customers are strongly advised to inform our staff of any allergies, intolerances, or dietary restrictions prior to placing an order. While we make reasonable efforts to accommodate such requests, we do not guarantee allergen-free environments.

Devifusion shall not be held liable for any adverse health effects arising from undisclosed allergies, incorrect information provided by the customer, or unavoidable cross-contact during food preparation.

5. Orders, Pricing & Payment Terms

All orders are subject to acceptance and availability. Prices listed on menus or online platforms are subject to change without prior notice.

Orders are considered confirmed only upon successful payment or explicit confirmation from our side. We reserve the right to cancel or refuse any order in cases of pricing errors, operational constraints, or suspected misuse.

6. Delivery & Third-Party Platform Responsibility

For orders placed through third-party platforms such as Swiggy and Zomato, the responsibility for delivery logistics, timelines, and rider conduct lies with the respective service provider.

While we ensure timely preparation and handover of orders, Devifusion shall not be liable for delays, damages, or service failures caused by such third-party platforms.

7. Catering Services & External Dependencies

Our catering services are designed to deliver quality food and service for both indoor and outdoor events. However, successful execution may depend on various external factors including venue readiness, infrastructure availability, weather conditions, and third-party arrangements.

The Company shall not be held responsible for delays or service issues arising due to such external dependencies beyond its control.

8. Limitation of Liability

To the maximum extent permitted under applicable Indian law, Devifusion shall not be liable for any indirect, incidental, or consequential damages arising from the use of its services.

In any case where liability is established, it shall be strictly limited to the value of the order or service in question. This limitation applies regardless of the nature of the claim.

9. Indemnification

By using our services, you agree to indemnify and hold harmless Devifusion, its management, employees, and affiliates from any claims, damages, or losses arising due to misuse of services, false declarations, or violation of these Terms.

10. Force Majeure

Devifusion shall not be held responsible for failure or delay in performance due to events beyond its reasonable control, including natural disasters, government restrictions, pandemics, or supply chain disruptions.

11. Intellectual Property Rights

All brand elements, including the name Devifusion, logo, menu design, website content, and promotional materials, are the exclusive property of the Company and may not be used without prior written consent.

12. Governing Law & Jurisdiction

These Terms shall be governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in Kolkata, West Bengal.

13. Amendments & Updates

Devifusion reserves the right to update or modify these Terms at any time. Continued use of services constitutes acceptance of the updated Terms.
